Constitutional Reform in Iraq and Sovereignty Challenges under International Influence: An Analytical Study

Abstract

This study provides an analytical examination of the mechanisms of constitutional reform in Iraq and the challenges to sovereignty under international influences, with particular focus on the Constitution of the Republic of Iraq of 2005. Constitutional sovereignty constitutes a fundamental pillar of state independence and represents the highest legal reference for organizing internal and external affairs. However, Iraq has faced significant challenges since 2003 due to increasing international influences, whether through international agreements and treaties or via political, economic, and regional pressures, which have affected the freedom of constitutional will and the centrality of national decision-making.
The study comprises two main sections. The first section addresses the internal challenges of constitutional reform, highlighting legal, political, and social obstacles that affect constitutional amendments, such as political fragmentation, institutional instability, and the issue of public legitimacy of constitutional provisions. The second section analyzes the impact of international influences on constitutional sovereignty, emphasizing how international obligations, particularly in the fields of human rights and treaties, have led to legal dualism, fragmentation of sovereign decision-making, and constraints on the state’s constitutional autonomy. The study also examines challenges related to the expansion of supranational obligations and their implications for redefining the limits of national sovereignty in the context of international commitments.The findings indicate that constitutional sovereignty in Iraq has become relative and adaptable to international influences, and that constitutional reform faces multiple challenges requiring a delicate balance between international obligations and the protection of national independence. The study concludes with several practical and legal recommendations, including: amending constitutional provisions to clarify the relationship with international treaties, enhancing public legal awareness, establishing mechanisms to evaluate international obligations before integration into national legislation, and reducing reliance on international support in the constitutional reform process to ensure national decision-making centrality.
This study aims to provide a comprehensive analytical framework for understanding the relationship between constitutional reform and constitutional sovereignty in Iraq within the context of legal globalization, serving as a reference for researchers and policymakers seeking to protect state independence while complying with international standards.
